In a case arising out of the United States District Court for the Eastern District of Texas, the United States Court of Appeals For The Federal Circuit has vacated a three-hundred-million dollars judgment against Apple mainly because of violations of Apple’s Seventh Amendment Constitutional Right to a jury trial which requires unanimity in jury verdicts.
There were three other errors, as well:
- There was an erroneous patent eligibility analysis under 35 U.S.C. § 101.
- There was an erroneous means-plus-function determination under 35 U.S.C. § 112 ¶ 6.
- There was an abuse of discretion in admitting prejudicial settlement evidence under Federal Rule of Evidence 403.
The case is titled, “Optis Cellular Technology v. Apple Inc.“
