The “Protect College Sports Act of 2026”

According to A Statement of Administration Policy, dated August 6, 2026, issued by Trump’s Executive Office of the President’s Office of Management and Budget, “[t]he unique American institution of collegiate athletics provides life-changing educational and leadership-development opportunities to more than 500,000 student-athletes through almost $4 billion in scholarships each year, fuels American Olympic success, and serves as an indelible part of many local economies and communities.” 

The Statement of August 6, 2026 specified that President Trump issued Executive Order 14322 (Saving College Sports) and Executive Order 14400 (Urgent National Action to Save College Sports) to direct Federal agencies to take appropriate actions and work with Congress to protect the future of college sports.

The Statement of August 6, 2026 indicated that the Trump Administration supports passage of S.4668, The Protect College Sports Act of 2026 (hereinafter, “the Act”).

Pros of the Act:

  • The Act includes a notice and an opportunity to cure period.
  • The Act requires good faith negotiation. 
  • The Act includes notice requirements prior to filing any civil actions.
  • The Act also includes whistleblower protection clauses.
  • The Act indicates that “[n]o predispute arbitration agreement shall be valid or enforceable if the agreement requires arbitration of a dispute arising under this section.”
  • In an enforcement action, relief may include compensatory damages, equitable relief, and temporary relief.
  • Significantly, the rights and remedies provided in certain parts of the Act “may not be waived by any agreement, policy form, condition of employment, or athletic agreement or participation.” 

Cons of the Act:

  • The Act does not include a provision which specifies how any “condition related to the student athlete’s participation in an intercollegiate sport” would be ‘treated’ for the genuine improvement of the student athlete overall health with actual, proven improvement of the student athlete’s health.

Next steps:

  • Congress may vote on the Act.
